Terms of Service

Effective September 4, 2026

These terms are a contract between you and Moon Five Technologies Inc. ("Moon Five", "we", "us"). They govern your use of moonfive.tech, the Moon Five tenant portal, and any Moon Five account you create (together, the "Services"). By using the Services you agree to these terms. If you do not agree, do not use the Services.

Please read section 10 carefully. It limits the amount we can be held liable for.

1. Who We Are

Moon Five Technologies Inc. is a California company that designs, installs, and operates electric vehicle charging systems for apartment buildings and other multifamily properties. Contact details for legal notices are given in section 15 at the bottom of this page.

2. Accounts and Sign In

Some parts of the Services require an account. You may create one by signing in with a supported identity provider, such as Google, or with an email address and password. You must be at least 18 years old, or the age of majority where you live, to create an account.

  • Give us accurate information and keep it current.
  • Keep your credentials confidential. You are responsible for activity under your account until you tell us it has been compromised.
  • Do not share an account, and do not let anyone else use yours.
  • Tell us promptly at legal@moonfive.tech if you suspect unauthorized access.

What we do with the identity information your provider sends us is described in our privacy policy, linked in the footer of every public page on this site.

3. The Services

The Services include informational pages, forms for joining a waitlist or checking whether a building qualifies for a program, and, for residents at a participating property, an account area for viewing charging activity and installation progress.

Eligibility results, savings figures, timelines, and program information shown on the site are estimates based on the information you provide and on program rules that can change. They are not an offer, a quote, a guarantee of service, or a guarantee that any incentive will be awarded.

We may add, change, suspend, or discontinue any part of the Services. Where a change materially reduces a paid service you already have, we will give reasonable notice.

4. Acceptable Use

You agree not to do any of the following.

  • Break the law, infringe the rights of others, or help someone else do either.
  • Submit false or misleading information, or personal information belonging to someone else, through our forms.
  • Probe, scan, or test the security of the Services, or bypass any access control, rate limit, or authentication mechanism.
  • Scrape, crawl, or bulk download the Services except as our robots.txt allows.
  • Interfere with the Services, the charging hardware, or the networks behind them, including by tampering with, damaging, or attempting to draw unmetered power from a Moon Five charger.
  • Upload malware, or use the Services to send spam or unsolicited messages.
  • Reverse engineer, decompile, or copy our software except where that right cannot be excluded by law.

5. Charging Sessions, Fees and Billing

Where charging is offered at your building, the price, the billing method, and the terms of access are set in the agreement between Moon Five and the property owner or manager, and in any separate resident agreement you sign. Those documents control if they conflict with this section.

Charging availability depends on grid conditions, building electrical capacity, and active load management. Sessions may be paced, paused, or deferred to keep the building within its electrical limits. We do not guarantee that a charger will be available, or that a session will deliver a particular amount of energy in a particular time.

6. Property and Building Participation

Installing charging at a building requires the property owner's consent, and often permits and utility approvals. Submitting a form or joining a waitlist does not commit Moon Five to install anything, and does not commit you to buy anything. Nothing on this site creates a tenancy, a license to occupy, or a right of access to any property.

7. Intellectual Property

The Services, including the software, text, graphics, photographs, layout, and the Moon Five name and logo, belong to Moon Five or our licensors and are protected by intellectual property law. We grant you a limited, revocable, non exclusive, non transferable license to use the Services for their intended purpose. All other rights are reserved. You keep ownership of the content you submit, and you grant us a license to use it to operate and improve the Services.

8. Third Party Services

The Services rely on third parties, including identity providers, cloud hosting, mapping, and messaging providers, and may link to sites we do not control. Your use of a third party service is governed by that party's own terms and privacy policy. We are not responsible for third party content, availability, or practices.

9. Disclaimers

The Services are provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, Moon Five disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error free, or that any information on them is accurate or complete.

Warranties for physical charging hardware, where they exist, are given in the applicable product warranty and are not affected by this section.

10. Limitation of Liability

To the fullest extent permitted by law, Moon Five and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of use, however caused and on any theory of liability, even if we were advised of the possibility.

Our total liability arising out of or relating to the Services is limited to the greater of one hundred United States dollars or the amount you paid Moon Five in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, so parts of the two paragraphs above may not apply to you. Nothing here limits liability for gross negligence, fraud, or personal injury where the law forbids that limit.

11. Indemnification

You agree to defend, indemnify, and hold harmless Moon Five from any claim, loss, or expense, including reasonable legal fees, arising out of your misuse of the Services, your breach of these terms, or your violation of any law or third party right.

12. Termination

You may stop using the Services at any time and ask us to close your account. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if continuing would create a security or safety risk. Sections 7 and 9 through 13 survive termination.

13. Governing Law and Disputes

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. You and Moon Five agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute that is not otherwise resolved, and each side waives any objection to venue there.

Before filing anything, please contact us so we can try to resolve the problem directly. Most issues are settled that way.

14. Changes to These Terms

We may revise these terms. When we do, we will update the effective date at the top of this page, and for material changes we will give notice on the site or by email before the change takes effect. Continuing to use the Services after a change takes effect means you accept the revised terms.
